Terms of Service

These Terms of Service (“Terms”) govern your use of the Prime Surface Systems Inc. website, Customer Estimator, Customer Portal, and related online tools (the “Services”). By using the Services, you agree to these Terms. A signed project contract, quote acceptance, or work order may contain additional terms that control for field installation work.
1. Operator
The Services are operated by Prime Surface Systems Inc., serving customers across Toronto, the GTA, Barrie, St. Catharines, and Southern Ontario. Contact: info@primesurfacesystems.ca.
2. Who may use the Services
You must be able to form a binding contract under applicable law. If you use the Services on behalf of a business, you confirm you are authorized to bind that business.
3. Accounts and security
If you create a Customer Portal or other account, you are responsible for keeping login credentials confidential and for activity under your account. Notify us promptly of unauthorized access.
4. Estimates and quotes
Online estimates are preliminary planning tools based on the information you provide. Final pricing, schedule, scope, and materials may change after an on-site assessment, substrate testing, or written quote confirmation. An estimate is not a commitment to perform work until we issue and you accept a formal quote or contract under our then-current commercial terms.
5. Acceptable use
You agree not to misuse the Services, including by:
- Submitting false, misleading, or fraudulent information
- Attempting to access another customer’s data
- Uploading malware or harmful content
- Scraping, reverse engineering, or disrupting the Services
- Using the Services for unlawful purposes
6. Photos, documents, and project content
You confirm you have the right to upload any photos, documents, or notes you submit. You grant us permission to use that content to prepare estimates, manage your project, and maintain records. Project photographs of completed Prime Surface Systems Inc. work may appear in our portfolio with appropriate consent where required.
7. AI-assisted features
AI features, where available, provide informational assistance only. They do not replace professional inspection, manufacturer instructions, or written warranty decisions. Material recommendations and project decisions remain subject to human review.
8. Intellectual property
The website design, branding, software, text, and other content are owned by Prime Surface Systems Inc. or its licensors. You may not copy or reuse them except as needed to use the Services or with our written permission.
9. Privacy
Personal information is handled as described in our Privacy Policy.
10. Disclaimers
The Services are provided on an “as available” basis. We work to keep the website accurate and available, but we do not warrant that online tools will be uninterrupted, error-free, or that preliminary estimates will match final field conditions.
11. Limitation of liability
To the fullest extent permitted by Ontario and Canadian law, Prime Surface Systems Inc. is not liable for indirect, incidental, special, or consequential damages arising from use of the online Services. Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law. Liability for performed flooring work is governed by the applicable project contract, warranty documents, and law.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Courts in Ontario have exclusive jurisdiction, subject to mandatory consumer protections.
13. Changes
We may update these Terms by posting a revised version on this page with an updated date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
